Terms of Service

1. Your Account

You must be at least 13 years old to use Surf. If you are under the age of majority where you live, you may only use Surf with a parent or guardian who agrees to these terms and is responsible for your activity. You are responsible for your account, for keeping your credentials secure, and for all activity that happens under your account. Notify us immediately at security@surfplatforms.com if you believe your account has been compromised.

2. Your Content

You own the content you create and share on Surf. By posting, you grant Surf a worldwide, non-exclusive, royalty-free, sublicensable (to our service providers and to other users as needed to run Surf) license to host, store, reproduce, format, display, and distribute your content solely to operate, secure, and improve the service, for example, serving your posts to your followers, generating previews, and producing transcoded video renditions.

This license ends within a reasonable time after you delete your content or account, except for content others have re-shared, residual backup copies, and anything we must keep by law or to prevent fraud, abuse, or safety risks. We do not use your private, end-to-end encrypted content to train AI models.

You are responsible for the content you post, and you confirm you have the rights to share it. Do not post content that is illegal, infringes the rights of others, or violates these terms or our Community Guidelines.

3. Acceptable Use

Your use of Surf must follow our Community Guidelines. Do not abuse the platform: no harassment, hate, impersonation, spam, malware, scraping, automated access without permission, attempts to circumvent rate limits or security controls, or interference with other users’ use of the service. These examples are not exhaustive.

We may remove content, or suspend or terminate accounts, that violate these terms or our Community Guidelines, with or without notice, to protect the community and the service. The decisions we make about what content to carry and how to present it are an exercise of our editorial discretion.

4. Subscriptions, Billing, and Auto-Renewal

Paid tiers (such as Sapphire, Pro, and Ultra) are billed through Stripe. The price, billing frequency, and the date of your next charge are shown before you buy. Surf does not store your full card details.

AUTO-RENEWAL: your subscription automatically renews for successive periods of the same length, and your payment method is charged the then-current price plus taxes at the start of each renewal period, UNTIL YOU CANCEL. You can cancel at any time from your billing settings (or, for purchases made through an app store, through that store), cancelling is at least as easy as subscribing, and access continues until the end of the paid period.

If you start a free or discounted trial, you may be charged the standard price when it ends unless you cancel first. We will give you advance notice of any price increase and, where required, the chance to cancel before it takes effect. Except where required by law, payments are non-refundable and there are no refunds for partial periods. Purchases through an app store are also subject to that store’s billing and refund rules.

5. Copyright and the DMCA

We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act. To report infringement, email our designated agent at legal@surfplatforms.com with the information the DMCA requires (identification of the work and the infringing material, your contact details, a good-faith statement, and a statement under penalty of perjury). If your content was removed by mistake, you may submit a counter-notification. We terminate the accounts of repeat infringers in appropriate cases.

If you are depicted in an intimate image shared without your consent (including AI “deepfakes”), you can request removal at legal@surfplatforms.com or in-app; we remove valid reports promptly, consistent with the TAKE IT DOWN Act.

6. Service Changes and Availability

Surf evolves continuously. Features may change, be added, or be removed, and we may offer beta or experimental features “as is.” We aim for high availability but do not guarantee uninterrupted service, and we are not liable for events beyond our reasonable control.

7. Disclaimers and Limitation of Liability

Surf is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, and we are not responsible for content posted by users or third parties.

To the maximum extent permitted by law, Surf and its affiliates are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, and our total liability for all claims relating to the service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you; nothing here limits liability that cannot be limited by law.

8. Indemnification

You agree to defend, indemnify, and hold harmless Surf Platforms Inc. and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the service, your violation of these terms or the law, or your violation of any third party’s rights.

9. Dispute Resolution, Arbitration, and Class Action Waiver

PLEASE READ THIS SECTION, IT AFFECTS YOUR LEGAL RIGHTS. First, we both agree to try to resolve any dispute informally for 30 days after written notice to legal@surfplatforms.com.

If that fails, you and Surf Platforms Inc. agree that disputes will be resolved by binding individual arbitration administered by JAMS under its Comprehensive (or Streamlined) Rules, governed by the Federal Arbitration Act, rather than in court. Either party may instead bring a qualifying claim in small-claims court and may seek court relief to protect intellectual-property rights. The right to seek public injunctive relief in court is preserved.

YOU AND SURF WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION; claims must be brought individually. If 25 or more coordinated demands are filed, they are resolved in sequential bellwether batches with tolling.

YOU MAY OPT OUT of arbitration within 30 days of first accepting these terms by emailing legal@surfplatforms.com with your name, account, and a clear opt-out statement. Opting out does not affect the rest of these terms or your use of Surf.

10. Governing Law

These terms are governed by the laws of the State of California (and, for arbitration, the Federal Arbitration Act), without regard to conflict-of-laws rules. To the extent litigation is permitted, the state and federal courts in Santa Clara County, California have exclusive jurisdiction, without depriving you of any mandatory consumer protections where you live.

11. The Full Agreement

These in-app terms summarize and are part of our complete legal agreement with you. The full Terms of Service, End User License Agreement, Privacy Policy, and Community Guidelines are incorporated by reference and available at surfplatforms.org/terms, surfplatforms.org/eula, surfplatforms.org/privacy-policy, and surfplatforms.org/guidelines. By using Surf you agree to all of them. If a binding term (such as arbitration) differs between documents, the full Terms of Service on our website control.

12. Termination

You may stop using Surf and delete your account at any time from account settings. We may suspend or terminate accounts that violate these terms or our Community Guidelines, or where required by law. Sections that by their nature should survive, including content license, disclaimers, liability limits, indemnification, arbitration, and the class-action waiver, survive termination.

13. Changes to These Terms

We may update these terms from time to time. Material changes will be announced in-app or by email, and we will give advance notice where required by law. Continued use of Surf after changes take effect constitutes acceptance of the updated terms.
